These SwapMyHunt Listings Terms and Conditions govern the creation, publication, viewing, communication, and coordination of listings on the SwapMyHunt platform, website, applications, and related services.
By accessing or using SwapMyHunt Listings, you agree to these Terms and Conditions, the SwapMyHunt Privacy Policy, the general Website Terms of Use, and any other policies published by New Traditions Outdoors, LLC.
If you do not agree to these terms, do not access, submit, respond to, or participate in any SwapMyHunt Listing.
1. Definitions
For purposes of these Terms:

“Company,” “we,” “us,” or “our” means New Traditions Outdoors, LLC.

“Platform” means SwapMyHunt, its website, applications, member areas, listing system, communications tools, and related services.

“Member,” “you,” or “your” means any person who accesses or uses the Platform.
-
“Listing” means an advertisement, offer, request, proposal, or other post submitted to the SwapMyHunt Listings system.
-
“Listing Owner” means the Member who creates or submits a Listing.
-
“Swap” means any agreement or arrangement made directly between Members.
-
“Outdoor Activity” means hunting, fishing, trapping where lawful, scouting, land stewardship, outdoor recreation, mentoring, equipment use, trips, access arrangements, or related activities.

“Content” means text, photographs, videos, audio, location information, messages, documents, reviews, and other materials submitted to or displayed through the Platform.

2. Purpose of SwapMyHunt Listings
SwapMyHunt Listings provides a communication and discovery platform that allows Members to:

Offer lawful hunting or fishing access.
-
Request lawful hunting or fishing access.
-
Offer or request trips, adventures, or outdoor experiences.
-
Offer or request land stewardship support.
-
Offer or request lawful hunting-related opportunities.
-
Offer or request gear or services where permitted by law.
-
Offer or request mentorship or educational assistance.
-
Coordinate other lawful outdoor arrangements approved by the Company.
SwapMyHunt is a member-to-member platform. The Company does not supervise, guarantee, insure, or endorse Swaps between Members.
3. Eligibility and Account Requirements
To use SwapMyHunt Listings, you must:

Be at least 18 years old, unless the Company expressly permits youth access under a parent or legal guardian consent process.

Provide accurate and current account information.
-
Maintain only one account unless the Company authorizes otherwise.
-
Keep your login information confidential.
-
Use the Platform only for lawful purposes.
-
Comply with all applicable federal, state, provincial, local, tribal, and international laws.
-
Maintain any licenses, permits, registrations, certifications, insurance, or approvals required for your proposed activity.
Members under the age of 18 may use the Platform only when permitted by the Company and with the required consent, supervision, and participation of a parent or legal guardian. A parent or legal guardian may be responsible for the minor’s use of the Platform and participation in any activity.
The Company may refuse, suspend, restrict, or terminate access if it cannot verify eligibility or determines that a Member presents a safety, legal, fraud, or policy concern.
4. Paid Membership and Listing Access
Only Members with an active paid subscription may submit SwapMyHunt Listings, unless the Company expressly states otherwise.
Access to Listing features may depend on the Member’s subscription plan. The Company may establish or change:

Which membership plans may submit Listings.
-
The number of Listings permitted per billing period.
-
Listing categories and feature access.
-
Listing visibility and search placement.
-
Photo, messaging, or contact features.
-
Verification or moderation requirements.
Current plan limits may include the following:
Membership plan maximum Listings
DIY 2 Active
Explorer 5 Active
Guide 10 Active
The Company may change these limits by updating the applicable membership information, pricing page, or Platform policies.
Deleting a Listing does not necessarily restore a previously used Listing allowance. The Company may count duplicate, replacement, expired, rejected, or removed Listings toward a Member’s applicable limit.
5. Listing Submission Requirements
Each Listing must be truthful, complete, current, and sufficiently detailed for other Members to understand the proposed opportunity or request.
Depending on the Listing type, Members may be required to provide:

Listing title.
-
Activity type.
-
General location.
-
Description.
-
What is offered.
-
What is wanted.
-
Preferred dates.
-
Experience level.
-
Number of participants.
-
Safety details.
-
Photos.
-
Verification information.
-
Listing status.
-
Expiration date.
-
Other information requested by the Company.
Listing Owners must accurately disclose material facts, including:

Whether they own, lease, manage, or have permission to use the property.
-
Whether access is private, public, commercial, or subject to restrictions.
-
Applicable license, permit, season, bag-limit, or participation requirements.
-
Physical hazards or unusual conditions.
-
Required equipment, physical abilities, experience, or training.
-
Whether firearms, bows, vehicles, boats, dogs, alcohol, or other equipment may be used.
-
Whether the activity involves minors, overnight stays, remote locations, water, elevated terrain, or other elevated risks.
-
Any known restrictions on guests, dates, species, methods, transportation, camping, parking, or lodging.
A Listing Owner may not misrepresent the quality, location, availability, legality, exclusivity, or expected result of an opportunity.
6. Lawful Activities Only
All Listings and Swaps must comply with applicable law.
Members may not use the Platform to arrange or promote:

Unlawful hunting, fishing, trapping, or wildlife activity.
-
Poaching or taking wildlife outside an authorized season.
-
Exceeding bag limits or possession limits.
-
Hunting or fishing without required licenses or permits.
-
Trespassing or unauthorized access to property.
-
Commercial activity requiring a license or permit that the Member does not possess.
-
Illegal guiding or outfitting.
-
Sale, transfer, or unlawful transport of firearms, ammunition, explosives, controlled substances, or regulated wildlife.
-
Unlawful sale or transfer of game, fish, meat, hides, antlers, or other regulated materials.
-
Activities involving protected, endangered, or restricted species without authorization.
-
Any arrangement that violates wildlife, boating, firearm, land-use, environmental, safety, or consumer-protection laws.
A Member is solely responsible for confirming that a proposed activity is lawful before agreeing to or participating in it.
7. Prohibited Listings and Conduct
The following are prohibited:

False, misleading, fraudulent, or deceptive Listings.
-
Listings using another person’s identity or property without authorization.
-
Listings that include inaccurate photos or locations.
-
Listings designed to collect personal information for unrelated purposes.
-
Spam, repetitive advertisements, or unauthorized solicitations.
-
Harassment, threats, intimidation, stalking, or abusive conduct.
-
Discrimination or hateful conduct prohibited by applicable law.
-
Sexual services, exploitative conduct, or inappropriate communications involving minors.
-
Requests for passwords, financial account credentials, Social Security numbers, or unnecessary identity documents.
-
Attempts to bypass membership requirements or Listing limits.
-
Manipulation of reviews, ratings, verification status, or Platform activity.
-
Malware, malicious code, automated scraping, or interference with the Platform.
-
Unauthorized commercial use of another Member’s Content.
-
Any activity that creates an unreasonable safety, legal, reputational, or security risk.
The Company may remove any Listing or Content that violates these Terms or that the Company determines should not remain available.
8. Member-to-Member Transactions and Swaps
All Swaps are arranged directly between Members. (At Guide Level Service the company will be the intermediator directly between members.)
The Company is not a party to any agreement between Members and does not:

Negotiate terms.
-
Set prices or exchange values.
-
Confirm property ownership.
-
Verify licenses or permits.
-
Inspect property, equipment, vehicles, boats, lodging, or facilities.
-
Guarantee access, game, fish, weather, harvest, safety, or performance.
-
Hold funds, deposits, property, equipment, or other consideration unless expressly agreed upon by all parties and stated in writing.
-
Enforce a Member’s promises or agreement.
Members are responsible for independently agreeing to all terms, including:

Dates and times.
-
Meeting locations.
-
Number of participants.
-
Permitted activities.
-
Access boundaries.
-
Equipment and transportation.
-
Costs, fees, deposits, or exchanges.
-
Cancellation terms.
-
Weather or emergency procedures.
-
Meat, fish, game, trophy, or gear ownership.
-
Alcohol and substance restrictions.
-
Supervision of minors.
-
Required licenses and permits.
-
Liability waivers and releases.
-
Insurance requirements.
-
Emergency contacts and communication methods.
Members should document important arrangements in writing before participating.
9. No Guarantee or Endorsement
A Listing’s appearance on the Platform does not mean that the Company endorses, approves, verifies, or recommends the Listing Owner, opportunity, property, equipment, service, or proposed activity.
The Company does not guarantee:

The identity or honesty of any Member.
-
The accuracy or completeness of a Listing.
-
The availability of an opportunity.
-
The condition or legality of property or equipment.
-
The quality or success of a hunting or fishing experience.
-
The safety of a location or activity.
-
That another Member will honor an agreement.
-
That a Member has the required licenses, permits, qualifications, or insurance.
-
That Content will remain available, accurate, or uninterrupted.
Members must conduct their own due diligence before relying on information contained in a Listing.
10. Verification
The Company may offer optional verification features. Verification may include confirmation of an email address, telephone number, identity, membership status, documents, property information, licensing or other information.
Verification does not guarantee that a Member, Listing, property, opportunity, or activity is safe, lawful, accurate, suitable, or endorsed by the Company.
The Company may request supporting information and may suspend or remove verification status at any time.
Members must not claim to be verified when they are not verified or misrepresent the scope of any verification.
11. Safety Responsibilities
Outdoor activities can involve serious risks, including injury, death, drowning, hypothermia, heat exposure, falls, firearms incidents, wildlife encounters, vehicle or boat accidents, equipment failure, remote locations, severe weather, intoxication, and inadequate communications.
Each Member is responsible for making an independent safety assessment and deciding whether to participate.
Members should:

Meet or communicate with the other Member before the activity.
-
Confirm identity and emergency contact information.
-
Share the itinerary with a trusted person.
-
Meet in a public location when practical.
-
Use appropriate safety equipment.
-
Follow firearm, boating, hunting, fishing, and land-access rules.
-
Confirm weather and environmental conditions.
-
Carry appropriate navigation, communication, medical, and emergency equipment.
-
Avoid participating while impaired.
-
Establish a check-in and emergency plan.
-
Confirm the experience and physical requirements of all participants.
-
Obtain appropriate insurance where available.
The Company does not provide emergency monitoring or emergency response. In an emergency, contact 911 or the appropriate local emergency service.
12. Firearms, Weapons, and Regulated Equipment
Members may not use the Platform to arrange unlawful firearm or weapon transactions.
Any lawful use of firearms, bows, crossbows, boats, vehicles, ATVs, tree stands, climbing equipment, traps, or other regulated or hazardous equipment must comply with all applicable laws and safety requirements.
Members are solely responsible for:

Legal possession and use.
-
Required licenses and permits.
-
Safe storage and transportation.
-
Safe handling and operation.
-
Confirming the qualifications of participants.
-
Disclosing relevant restrictions before participation.
The Company does not inspect, approve, rent, sell, or insure firearms, weapons, vehicles, boats, or other equipment listed or discussed by Members.
13. Property Access and Landowner Permission
A Member offering access must have the legal authority or express permission to offer that access.
Members may not:

Enter land without permission.
-
Offer access to property they do not control or have permission to use.
-
Misrepresent public, private, leased, or restricted land as available.
-
Exceed the scope of permission granted by a landowner or manager.
-
Damage crops, fences, gates, roads, structures, habitat, or other property.
-
Leave trash, bait, feed, equipment, blinds, stands, or other materials without authorization.
-
Disclose sensitive locations in a manner that creates an unreasonable risk to landowners, wildlife, or property.
Members must comply with all posted signs, access rules, landowner instructions, and applicable laws.
14. Photos, Locations, and Sensitive Information
Members must have the right to upload and share photographs, videos, maps, and other Content included in a Listing.
Members should avoid publicly disclosing:

Exact locations of residences.
-
Gate combinations or security information.
-
Private phone numbers or email addresses.
-
Hunting-stand locations where disclosure creates a safety or property risk.
-
Sensitive wildlife locations.
-
Personal information belonging to another person.
-
Financial or identity documents.
-
Information that could facilitate trespassing, theft, poaching, or other unlawful conduct.
The Company may blur, remove, restrict, or generalize location information for safety, privacy, or security reasons.
15. User Content License
By submitting Content to the Platform, you grant New Traditions Outdoors, LLC a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, format, display, distribute, promote, and use that Content as reasonably necessary to operate, market, improve, secure, and provide the Platform.
This license continues for as long as the Content is needed for those purposes, subject to the Company’s Privacy Policy and applicable law.
You retain ownership of your Content. You represent that:

You own or control the necessary rights.
-
Your Content does not violate another person’s rights.
-
Your Content does not contain unlawful or misleading material.
-
You have permission from identifiable individuals shown in the Content where required.
-
Your Content does not expose the Company to legal liability.
The Company may remove or disable access to Content at any time.
16. Communications and Privacy
Members may communicate through the Platform or through contact information shared in accordance with the Privacy Policy.
Members must use another Member’s contact information only for the Listing or Swap for which it was provided, unless the person gives additional permission.
Members may not:

Sell or distribute another Member’s contact information.
-
Add another Member to marketing lists without consent.
-
Contact a Member repeatedly after being asked to stop.
-
Use information obtained through the Platform for harassment, fraud, stalking, or unrelated solicitation.
-
Request unnecessary sensitive personal information.
The Company may monitor, review, preserve, or disclose communications and Content when reasonably necessary to operate the Platform, investigate violations, protect Members, comply with law, or protect the Company’s rights.
17. Fees, Payments, and Exchanges
The Company may charge membership fees, Listing fees, service fees, or other charges disclosed at the time of purchase.
Unless expressly stated otherwise:

The Company does not process or guarantee payment between Members.
-
Members are responsible for determining the value and terms of any exchange.
-
Members are responsible for taxes, permits, licenses, and reporting obligations.
-
Members should avoid sending cash or sensitive financial information to unknown persons.
-
The Company is not responsible for failed payments, chargebacks, fraud, nonperformance, or disputes between Members.
Members may not use the Platform to facilitate unlawful sales or transfers of regulated goods or services.
18. Cancellations and Expiration
Listing Owners must keep Listings current and promptly update or remove Listings that are no longer available.
The Company may automatically expire Listings after the stated expiration date or after a period of inactivity.
The Company may remove Listings that are:

Expired.
-
Completed.
-
Unavailable.
-
Reported.
-
Inaccurate.
-
Duplicative.
-
Noncompliant.
-
Associated with a suspended account.
-
Determined to present a safety or legal concern.
Unless expressly provided by the Company, removal or expiration of a Listing does not create a refund, credit, or restoration of a Listing allowance.
19. Reports and Moderation
Members may report Listings, Content, or conduct that they believe violates these Terms or creates a safety, fraud, or legal concern.
The Company may investigate reports and take action, including:

Requesting additional information.
-
Editing or limiting visibility.
-
Removing a Listing.
-
Suspending or terminating an account.
-
Restricting messaging or contact features.
-
Removing verification status.
-
Preserving relevant information.
-
Referring matters to law enforcement or other authorities when appropriate or legally required.
The Company does not guarantee that it will investigate every report or take a specific action.
False, malicious, or abusive reports may violate these Terms.
20. Disputes Between Members
SwapMyHunt provides a peer-based dispute resolution process for certain disputes arising from Listings, communications, or Swaps between Members.
The process is administered by a Peer Member Resolution Team consisting of three to five Members selected or approved by New Traditions Outdoors, LLC. Panel members are required to, follow confidentiality obligations, disclose conflicts of interest, and comply with procedures established by the Company.
The Peer Member Resolution Team is intended to provide a fair, orderly, and practical process for reviewing disputes between Members. The Company may modify, suspend, or discontinue the process at any time. (Please see full Member Dispute Policy for details)
The Company is not responsible for recovering money or property between Members.
21. Assumption of Risk
By using the Platform or participating in an activity arranged through a Listing, you acknowledge that outdoor activities may involve known and unknown risks.
You voluntarily assume responsibility for risks arising from or related to:

Travel to or from an activity.
-
Hunting, fishing, boating, camping, scouting, or other outdoor activity.
-
Firearms, bows, vehicles, boats, tools, equipment, or animals.
-
Terrain, water, weather, wildlife, insects, plants, disease, or remote locations.
-
Conduct or negligence of another participant.
-
Incomplete, inaccurate, or outdated Listing information.
-
Property conditions.
-
Emergency response limitations.
-
Your own physical condition, judgment, preparation, or conduct.
You are responsible for determining whether you are qualified, equipped, medically able, and legally authorized to participate.
22. Disclaimer of Warranties
To the maximum extent permitted by law, the Platform and all Listings are provided on an “as available” and “as is” basis.
The Company disclaims all warranties, express or implied, including warranties of:

Accuracy.
-
Availability.
-
Merchantability.
-
Fitness for a particular purpose.
-
Non-infringement.
-
Safety.
-
Reliability.
-
Security.
-
Suitability.
-
Legal compliance by Members.
-
Quality or success of any Listing or Swap.
The Company does not warrant that the Platform will be uninterrupted, error-free, secure, or free of harmful code.
23. Limitation of Liability
To the maximum extent permitted by law, New Traditions Outdoors, LLC and its owners, members, managers, officers, employees, contractors, agents, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

Use of or inability to use the Platform.

Any Listing or Swap.
-
Member conduct.
-
Injury, death, property damage, or financial loss.
-
Unauthorized access or security incidents.
-
Inaccurate or misleading Content.
-
Failed, canceled, or disputed transactions.
-
Loss of data, revenue, business, opportunity, or goodwill.
To the maximum extent permitted by law, the Company’s total aggregate liability for claims related to the Platform will not exceed the greater of:

The amount you paid to the Company for the relevant Platform service during the twelve months before the event giving rise to the claim; or
-
One hundred dollars.
Some jurisdictions do not allow certain limitations, so portions of this section may not apply to every Member.
24. Indemnification
You agree to defend, indemnify, and hold harmless New Traditions Outdoors, LLC and its owners, members, managers, officers, employees, contractors, agents, affiliates, licensors, and service providers from claims, damages, losses, liabilities, penalties, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

Your Listings or Content.
-
Your use of the Platform.
-
Your participation in a Swap or Outdoor Activity.
-
Your violation of these Terms.
-
Your violation of any law or third-party right.
-
Your conduct toward another Member.
-
Injury, death, property damage, or loss caused by your acts or omissions.
-
Your failure to obtain required permission, license, permit, insurance, or authorization.

25. Account Suspension and Termination
The Company may suspend, restrict, or terminate your account or remove Listings at any time if:

You violate these Terms.
-
You provide inaccurate information.
-
You fail to maintain an active subscription.
-
Your conduct creates a safety, fraud, legal, or security concern.
-
The Company receives a complaint or legal request.
-
The Company discontinues or changes the Listing service.
-
Action is necessary to protect Members or the Company.
You may stop using the Platform at any time. Termination does not eliminate obligations that by their nature should continue, including provisions concerning Content, disputes, liability, indemnification, privacy, and governing law.
26. Changes to These Terms
The Company may modify these Terms by posting an updated version on the Platform.
Changes become effective when posted unless a later effective date is specified. Continued use of SwapMyHunt Listings after changes become effective constitutes acceptance of the updated Terms.
If you do not agree to revised Terms, you must stop using the Listing system.
27. Governing Law and Venue
These Terms are governed by the laws of the State ofMontana, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, disputes arising from or relating to these Terms or the Platform must be brought in the state or federal courts and you consent to that jurisdiction and venue.
The Company may seek injunctive or equitable relief in any court with jurisdiction to protect its intellectual property, confidential information, Platform, Members, or legal rights.
28. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full effect.
29. No Waiver
The Company’s failure to enforce any provision of these Terms does not waive its right to enforce that provision later.
30. Entire Agreement
These Terms, together with the Privacy Policy, general Website Terms of Use, membership terms, and any additional policies incorporated by reference, constitute the entire agreement concerning your use of SwapMyHunt Listings.
