Member Dispute Resolution Policy

20. Member Dispute Resolution Process

SwapMyHunt provides a peer-based dispute resolution process for certain disputes arising from Listings, communications, or Swaps between Members.

The process is administered by a Peer Member Resolution Team consisting of three to five qualified Members selected or approved by New Traditions Outdoors, LLC. Panel members may be required to complete training, follow confidentiality obligations, disclose conflicts of interest, and comply with procedures established by the Company.

The Peer Member Resolution Team is intended to provide a fair, orderly, and practical process for reviewing disputes between Members. The Company may modify, suspend, or discontinue the process at any time.

20.1 Matters Eligible for Review

A Member may request review of a dispute involving:

  • A Listing.

  • Communications between Members.

  • A proposed or completed Swap.

  • Alleged misrepresentation.

  • Failure to honor an agreed arrangement.

  • Property-access disagreements.

  • Conduct related to the Platform.

  • Alleged violations of Listing rules or Member obligations.

The Company may decline to submit a dispute to the Peer Member Resolution Team if the matter:

  • Involves an emergency or immediate threat.

  • Requires law-enforcement action.

  • Involves alleged criminal conduct.

  • Concerns a matter outside the Platform.

  • Requires a legal determination that the panel is not qualified or authorized to make.

  • Involves a Member who is suspended, terminated, unreachable, or unwilling to participate.

  • Would create a conflict of interest or unreasonable safety concern.

  • Is duplicative, abusive, frivolous, or submitted in bad faith.

The Company may refer matters to law enforcement, regulators, insurers, attorneys, or other appropriate parties when permitted or required by law.

20.2 Requesting Resolution

A Member requesting review must submit a dispute report through the process designated by the Company.

The request should include:

  • The names or account information of the Members involved.

  • The Listing or Swap involved.

  • A clear description of the dispute.

  • The requested outcome.

  • Relevant dates and locations.

  • Copies of supporting documents.

  • Screenshots or other evidence.

  • Names of relevant witnesses, if applicable.

  • Any safety, legal, or financial concerns.

The Company may require the requesting Member to certify that the information submitted is truthful and complete to the best of that Member’s knowledge.

20.3 Notice to the Other Member

After receiving a valid request, the Company may notify the other Member and provide a summary of the dispute and the applicable response deadline.

Each Member will have a reasonable opportunity to:

  • Review the allegations.

  • Submit a written response.

  • Provide supporting evidence.

  • Identify relevant communications.

  • Explain the requested resolution.

  • Respond to evidence submitted by the other Member.

A Member’s failure to respond by the deadline may allow the Peer Member Resolution Team to review and decide the matter based on the information available.

20.4 Panel Selection and Conflicts of Interest

The Company will select a panel of three to five Peer Member Resolution Team members for each dispute.

A panel member must disclose any actual or potential conflict of interest, personal relationship, prior dispute, financial interest, or other circumstance that could reasonably affect impartiality.

The Company may remove and replace a panel member when it determines that a conflict, safety concern, confidentiality concern, or other issue exists.

The parties may identify a reasonable conflict concern in writing. The Company will determine whether a panel member should be replaced. The Company’s decision regarding panel composition is final for purposes of the Platform’s dispute process.

20.5 Evidence Reviewed by the Panel

The Peer Member Resolution Team may review all evidence that it considers relevant, including:

  • Listing information.

  • Listing history and changes.

  • Platform messages.

  • Email or text communications voluntarily submitted by a Member.

  • Photos and videos.

  • Agreements, releases, receipts, or other documents.

  • Payment records voluntarily submitted by a Member.

  • Location or scheduling information.

  • Witness statements.

  • Reports submitted to the Company.

  • Account and verification information permitted to be disclosed.

  • Other information provided by either Member or requested by the Company.

The Company may redact or withhold information when necessary to protect privacy, confidential information, personal safety, security, legal rights, or the integrity of the Platform.

A Member must not alter, fabricate, selectively manipulate, or knowingly misrepresent evidence.

20.6 Cooperation and Good-Faith Participation

By using SwapMyHunt Listings, each Member agrees to participate in the dispute process in good faith when the Company refers a matter to the Peer Member Resolution Team.

Members must:

  • Respond truthfully and within applicable deadlines.

  • Provide relevant evidence in their possession or control.

  • Preserve relevant communications and documents.

  • Avoid harassment, retaliation, threats, or intimidation.

  • Cooperate with reasonable requests from the Company or panel.

  • Respect the confidentiality of the process.

  • Follow temporary instructions issued by the Company while the dispute is pending.

Members may not interfere with, pressure, bribe, threaten, or improperly contact panel members concerning a dispute.

20.7 Panel Recommendation and Member Obligation

After reviewing the available evidence, the Peer Member Resolution Team will issue a written recommendation or determination explaining the principal facts considered and the recommended resolution.

The recommendation may address Platform-related remedies, including:

  • Correcting or updating Listing information.

  • Cancelling or clarifying a Listing.

  • Requiring a Member to stop specified conduct.

  • Requiring a Member to return or surrender property when legally appropriate and voluntarily available.

  • Requiring a correction, clarification, or apology.

  • Recommending a refund or reimbursement between Members.

  • Recommending a replacement arrangement.

  • Restricting communication or contact.

  • Removing Content.

  • Suspending Listing privileges.

  • Referring the matter to Company moderation.

  • Suspending or terminating a Member’s Platform access.

By submitting a Listing, responding to a Listing, or participating in a Swap, each Member agrees to abide by the panel’s recommendation or determination as a condition of continuing to use SwapMyHunt.

A Member who refuses to comply may have their account, Listing privileges, messaging access, verification status, or membership restricted, suspended, or terminated.

The panel’s recommendation does not authorize a Member to take property, enter land, access an account, impose a debt, use force, or take any other action prohibited by law. Any payment, property transfer, refund, or other remedy must be completed directly between the Members unless the Company expressly provides otherwise.

20.8 Company Enforcement

The Peer Member Resolution Team may make a recommendation, but the Company retains exclusive authority over Platform-related enforcement decisions.

The Company may accept, modify, reject, or supplement a panel recommendation based on:

  • Safety concerns.

  • Legal requirements.

  • New evidence.

  • Policy violations.

  • Conflicts of interest.

  • Fraud concerns.

  • Privacy or security concerns.

  • The need to protect Members or the Platform.

Company actions may include:

  • Removing or editing a Listing.

  • Suspending or terminating an account.

  • Restricting messaging or contact features.

  • Removing verification status.

  • Limiting access to the dispute process.

  • Requiring additional verification.

  • Referring the matter to law enforcement or another authority.

A panel recommendation does not limit the Company’s right to take independent action under these Terms.

20.9 Confidentiality

Members, panel members, and Company personnel must treat dispute materials as confidential and may use them only for evaluating, administering, or enforcing the dispute process, except where disclosure is:

  • Authorized by the person who provided the information.

  • Necessary to protect a person or the Platform.

  • Required by law, subpoena, court order, or government request.

  • Necessary to investigate fraud, abuse, threats, or unlawful conduct.

  • Necessary to obtain legal, insurance, or professional advice.

  • Necessary to enforce a panel recommendation or Company decision.

Members must not publicly post, publish, distribute, or use dispute materials to harass, threaten, embarrass, retaliate against, or expose another Member.

20.10 No Guarantee of a Particular Result

The Company does not guarantee that the Peer Member Resolution Team will resolve every dispute, reach a unanimous recommendation, review every item submitted, or produce a result favorable to either Member.

The panel may base its recommendation on the available evidence, including when one Member fails to participate.

The panel’s recommendation may not reflect a judicial finding, legal judgment, arbitration award, or determination by a government agency.

20.11 No Emergency, Criminal, or Legal Substitute

The Peer Member Resolution Team is not an emergency response service, law-enforcement agency, court, arbitrator, mediator, insurer, or legal advisor.

Members must immediately contact emergency services for emergencies and appropriate authorities for suspected criminal conduct, threats, violence, missing persons, serious injury, or other urgent matters.

Participation in the Peer Member Resolution Team process does not prevent a Member from:

  • Contacting law enforcement.

  • Reporting conduct to a regulatory agency.

  • Seeking medical treatment.

  • Filing an insurance claim.

  • Consulting an attorney.

  • Filing a lawsuit.

  • Seeking a court order or other legally available remedy.

A Member may be required to notify the Company if a dispute becomes the subject of a legal proceeding, government investigation, protective order, or criminal investigation.

20.12 No Waiver of Legal Rights

The dispute process does not waive any non-waivable legal right or remedy.

Nothing in this section prevents either Member from pursuing claims or defenses that cannot legally be waived. However, Members remain bound by the Platform-related requirements and enforcement actions described in these Terms.

20.13 Finality of Platform Decisions

The panel’s recommendation and any resulting Company enforcement action are final for purposes of continued access to SwapMyHunt Listings, unless the Company elects to reopen the matter because of substantial new evidence, a procedural error, a conflict of interest, fraud, or another significant concern.

The Company is not required to provide an appeal process. If the Company permits an appeal, the appeal must be submitted within the deadline provided and must identify the specific error, new evidence, or procedural issue relied upon.

Member Acknowledgment

I understand that disputes involving SwapMyHunt Listings or Swaps may be referred to a Peer Member Resolution Team consisting of three to five Members. I agree to participate in good faith, provide truthful and relevant evidence, preserve and submit applicable communications, respect confidentiality, and abide by the panel’s recommendation or determination as a condition of continued use of SwapMyHunt. I understand that the Peer Member Resolution Team is not a court, law-enforcement agency, emergency service, insurer, or legal advisor, and that New Traditions Outdoors, LLC retains authority over Platform-related enforcement decisions.
